TERMS AND CONDITIONS LEIDEN MARATHON
Article 1 Definitions
1. In these general terms and conditions,
2. Event: a running/walking competition that is part of the
Leiden Marathon event to be organized in any year .
3. Participant: the natural person, not acting as an entrepreneur, who engages in a
has registered for participation in the
event as permitted by the Organizer
4. Agreement: the agreement for the participation of the Participant in the
Event
5. Organiser: the Leiden Marathon Foundation (KvK 41168219)
6. These general terms and conditions apply to every agreement
ARTICLE 2 PARTICIPATION
1. Participation in the Event is only possible for a natural person
who
has reached at least the minimum age determined by the Organizer on the day of the event . See www.marathon.nl
2. The Participant may only participate in the Event if he
has completed the
registration form to that effect completely and truthfully, if the registration fee has been paid in full and if the participant has agreed to the
general terms and conditions. The Organizer reserves the right at all times
to remove registrations with false personal data.
3. Participation in the Event is done by the Participant personally. It is
therefore not permitted to allow another person
to take part in the Event instead of the Participant
4. Transferring an Agreement to a third party is possible with the consent
of the Organizer
5. If a Participant in the Marathon, Half Marathon, 10km, 5km and
Kids Run is unable to participate in the event, the
registration fee paid will not be refunded. Even in the event of a change in the distance for which
registration has been made, no refund of the registration fee, or part thereof, will be made.
Change to a higher distance is only possible, subject to payment of the difference with the price of
the higher distance, after consultation with the Organizer.
6. The Participant undertakes upon registration to pay the registration fee,
including ordered extras, and/or payments for charity, regardless of
actual participation.
7. If the Event cannot
take place due to exceptional circumstances , the Participant can choose for a voucher for the next Event or
forgo this option in other words donate the registration fee. If the
Participant cannot use the voucher during the next Event
, the Participant can
receive a refund of the registration fee after the end of the voucher period . The participant must submit an application for this to the
Organization. If a participant can not participate in advance to the
next event the Participant reimbursement of the enrollment fee can
ask the Organization
under “registration” includes any donation to the
Organizer of the Event related charity and any ordered
extras like eg engraving medal, SMS Service. An exception to this is
a possibly ordered T-Shirt. This will be refunded. Other expenses, costs,
etc. will in no case be refunded or reimbursed.
8. The Organizer may decide to
prematurely end, suspend or neutralize the Event on the basis of exceptional circumstances . In
exceptional circumstances, the Organizer may also decide to change the
route to be run or the distance to be covered. In the aforementioned cases, no
refund of the registration fee will be made.
9. A decision by the Organizer not to allow the Event to take place
does not create any liability for reimbursement of the
costs incurred by the Participant .
ARTICLE 3 LIABILITY
1. Participation is at your own risk. The Organizer is not liable for
any damage, by whatever name, that the Participant may suffer as a result of the
Participation, unless this damage is the direct result of
intent or gross negligence attributable to the Organiser . This exclusion of liability also applies to
serious types of damage, such as all possible types of damage as a result of injury or
death.
2. If, despite the provisions of the first paragraph of this article, liability
must be assumed on the part of the Organizer for damage suffered by the Participant, the
obligation of the Organizer to compensate for that damage up to a maximum of the
amount that the insurer of the Organizer pays in respect of that damage. The
Participant must be adequately insured against the risk of damage that he or
a surviving relative may suffer as a result of his death, injury or illness,
caused by his participation in the Event
3. The Participant declares that he is aware that participation is a good
requires health in both a psychological and physical sense, and declares that he meets this
requirement and that he will have adequately
prepared himself for the Event through training and otherwise . The Organizer explicitly
and urgently advises the Participant to
undergo a sports medical examination in connection with participation in the Event.
4. The Participant indemnifies the Organizer against damage that third parties may suffer as
a result of an act or omission attributable to the Participant with
regard to the Event. The Participant must be adequately insured against
the risk of liability for the damage referred to.
5. Sponsors of the Event and the municipality(s) and province in which the
Event takes place, are excluded from
liability on the same basis as the Organiser.
ARTICLE 4 PORTRAIT RIGHT
Participant grants permission in advance to the Organizer and its partners for the
publication of photos and visual material and the
like taken during or around the Event , on which the Participant is visible.
Article 5 Personal data
The personal data provided by the Participant will be included in
a file by the Organizer . By entering into the Agreement, the Participant grants
the Organizer permission to use the personal data to send information to the
Participant and to provide the personal data to the Organizer and its partners
for the purpose of sending information to the Participant. It is the Participant at all
at any time is allowed to indicate in writing or by e-mail that it objects to the
sending of information by the Organizer or to the provision of personal data,
after which the Organizer will stop that sending or that provision.
By entering into the Agreement, the Participant grants permission to the Organizer to
compile rankings in which the Participant is mentioned and
to publish his name and competition results, for example by means of publication in newspapers and via the
Internet. The Organizer declares that all data of the Participant will be handled with care and
that they will only be used for the purpose for which they were submitted.
ARTICLE 7 COMPETITION RULES
Participation by the Participant in the Event is subject to the
Leiden Marathon competition regulations, which are part of these general terms and conditions.
ARTICLE 8
If one or more articles of these terms and conditions are invalid or illegal, for whatever
reason, this does not affect the validity of the other parts of the
terms and conditions.
