Terms and conditions - Leiden Marathon

Article 1 Definitions

In these general terms and conditions, the following terms shall have the meanings set out below:

Participant: the natural person, not acting in a commercial capacity, who has registered to take part in the Event in a manner authorised by the Organiser.

Event: any running race or walking event organised by the Organiser in any given year.

Organiser: Stichting Marathon Leiden, with its registered office at J.C. de Rijpstraat 30, 2315 WE, Leiden.

Agreement: the agreement between the Participant and the Organiser, relating to the Participant’s participation in the Event.

Article 2 Participation

Registration for the Event constitutes an Agreement between the Participant and the Organiser and provides the Participant with proof of participation.

Participation in the Event is only open to persons of the minimum age set by the Organiser. The minimum age for a participant depends on the distance.

The Participant may take part in the Event provided they have completed the relevant registration form fully and truthfully and the registration fee due has been paid in full.

Article 3 Liability

The Organiser shall not be liable for any injury, however named or classified, suffered by the Participant as a result of taking part in the Event, unless such injury is a direct consequence of wilful misconduct or gross negligence attributable to the Organiser.

If, notwithstanding the provisions of the first paragraph of this article, the Organiser is held liable for damage suffered by the Participant, the Organiser’s obligation to compensate for such damage shall be limited to no more than the amount paid out by the Organiser’s insurer in respect of that damage.

Article 4 Image Rights

The Participant hereby grants the Organiser and its partners prior consent to publish photographs, video footage and similar material taken during or around the Event in which the Participant is visible. The photographs and videos taken of the Event are the property of the Organiser.

Article 5 Personal Data

The personal data provided by the Participant will be recorded by the Organiser in a database. By entering into the Agreement, the Participant grants the Organiser permission to use the personal data for the purpose of sending information to the Participant and publishing the results.

Article 6 Competition Rules

The Participant’s participation in the Event is governed by the Leiden Marathon Competition Rules, which are available on request or via the Organiser’s website, and by the regulations referred to in these competition rules.

Article 7 Final Provisions

In all cases not adequately covered or otherwise not provided for in these general terms and conditions, the Organiser shall decide.

Any deviation from these terms and conditions is only possible by written agreement.

Only the Dutch version of these general terms and conditions is authentic; should a translation differ in any respect, the Dutch text shall prevail.

Article 8 Governing Law and Dispute Resolution

The relationship between the Participant and the Organiser, and all legal relationships arising therefrom, shall be governed by Dutch law.

In the event of a dispute between the Organiser and the Participant, the parties shall first consult to determine whether the dispute can be resolved through mediation. Should this not be possible, the dispute shall be submitted to the competent court in the district of The Hague.
